Lancaster County, SC, located in the fast-growing and highly desirable Charlotte, NC region, is the third fastest growing county in South Carolina with a population of 102,000. The County is governed under the Council – Administrator form of government and includes six elected officials as department directors. The workforce consists of 684 full-time employees and approximately 500 part-time employees and operates on a combined funds budget of over $125 million for FY23. The County consists of one city and three towns and is working to balance suburban growth and rural area service needs. The County is seeking qualified candidates for the County Attorney position to provide legal services and counsel to the County Administrator, County Council, as well as County Departments, Boards, and Commissions. The County Attorney will be a highly visible and key member of the County’s Leadership team with a new, dynamic County Administrator and a forward-looking, cohesive seven-member County Council.
Examples of Duties
The County Attorney will serve as a legal advisor and re-establish legal processes for the County, as the County transitions from contracted, outside legal counsel for the past four years. The County Attorney will represent Lancaster County in legal and administrative hearings and attend all County Council meetings and other required meetings, such as Board and Commission meetings and meetings with outside parties. The County Attorney will create formal correspondence and communicate the County’s legal position on various issues, ensure compliance with the Freedom of Information Act and coordinate the County’s response process for information requests. The County Attorney will review claims against the County for potential dismissal, settlement or litigation. The County Attorney will also provide guidance on ethical issues and State Ethics Act compliance. Further job duties include review and preparation of legal documents and reports including messages and memoranda, administrative documents, ordinances, resolutions, minutes, formal correspondence, contracts, legal pleadings, news releases, etc. The County Attorney will assist in coordinating and monitoring the defense of lawsuits brought against Lancaster County and initiate, or coordinate and monitor, affirmative litigation on behalf of the County. The County Attorney will coordinate with outside counsel for bond matters, labor law issues, and other specialized areas of legal practice at the request of the County Administrator and as needed
The ideal candidate will have at least seven years of local government law experience, county government experience preferred, and have a proactive approach to legal issues and risk management, with a high degree of problem-solving capabilities and internal customer service. Candidates must have strong legal research and writing skills and ability to communicate effectively, orally and in writing. A strong work ethic and ability to multi-task with attention to detail is critical. Candidates must possess a Juris Doctorate from an accredited school of law and experience in local government, government law or with a public agency, or an equivalent combination of experience and training which provides the required knowledge skills and abilities. Candidates must be admitted to practice in South Carolina, be in good standing with the South Carolina Bar, and have completed all Rule 403 requirements. Possession of an appropriate driver’s license that is valid in the State of South Carolina is required. Hiring range is from $118,000 to $130,000 and will be based on qualifications and experience.
